What documents are needed by an NRI investor when starting to invest in mutual funds in India?
An NRI needs a PAN, passport, overseas address proof, an NRE/NRO bank account, KYC documents, FATCA/CRS declaration, tax residency details and TIN or an equivalent tax identification number. Apart from this, depending on the AMC, country of residence, additional documents such as a visa, residence permit, CDC or bank-account proof may also be required. There can be some additional requirements or restrictions for NRIs from US and Canada. This could be because of FATCA/CRS related compliance. Another additional thing is TDS deduction applicable on redemption.
Below is the list of each document needed for NRI investors to invest in Mutual Funds in India
1. Aadhaar
You probably know this one better than any other document in this list. A simple 12 digit id number issued by UIDAI. Most probably you already have this one so no worries here.
It is used for the KYC. However, it is not a specific mandatory requirement for all NRI investors. Passport can also be used for this, depending on the KYC process.
2. PAN
PAN is perhaps the second most common document in this list. It is a Permanent Account Number issued by the Income Tax Department. If you have a bank account, then there is a high chance you already have this one.
PAN is a requirement for financial and tax-related transactions in India, including mutual fund investments. All of your mutual fund investments will be linked to your PAN, no matter from what platform you use to invest.
If you do not already have a PAN, you can easily apply through the Income Tax Department’s prescribed PAN application process.
Although, it is a basic document and easily obtainable. One thing to remember is that the name and other personal details on the PAN match exactly with your other documents.
This is also not an NRI specific document. You will still need it for investing even if you are not an NRI.
3. NRE/NRO Bank Account Details
When starting to invest, you need a valid bank account proof. This can include Bank passbook or cancelled cheque or account statement. For NRIs however, this requirement changes a little bit.
An NRE or NRO bank account is needed if you want to invest as an NRI.
Whatever account you will choose will be used to invest from and also to receive money in the case of redemption as well.
If you don’t have this account then you need to contact your bank branch and they can assist you in setting up this account.
4. Passport
You will need passport during the KYC process as an NRI. Considering the importance of this document, as an NRI there is a high chance that you already have this. You will need to keep it handy when you’re starting to invest in mutual funds.
Again, make sure the passport is valid and that the personal details match the PAN and other KYC documents.
5. Overseas Address Proof
If you have a foreign government issued id, electricity or utility bill, or bank account then these can be used as overseas address proof.
This is an important part of KYC and is basically used to establish where the investor is currently residing.
Since this can generally be done by already existing documents, you don’t need to obtain any special permission or documents. Just an existing document with your name and current address will be enough. It should meet KYC requirements.
6. Visa, CDC or Residence Permit
This requirement will depend on what type of NRI you are.
While dealing with investors in Dharamshala and Kangra, I have come across many seafarers who get confused on the Visa requirements. If you are a seafarer, then you most probably will need a Continuous discharge certificate: CDC. Or else you will just need a normal Visa or residence/work permit.
This is to demonstrate the residence and employment of the individual.
Depending on which category you are, you can obtain these documents fairly easily. In most cases, you will already have these documents.
The requirement of this one depends on the KYC or AMC process.
7. FATCA/CRS Self-Declaration
The FATCA/CRS declaration is meant to get information about the investor’s foreign tax residency and related details.
This is used to comply with international tax reporting.
An NRI may need to declare the countries in which they are tax resident and provide the relevant tax identification numbers. The documents for that are mentioned in the next point.
This is normally completed as part of the mutual fund/AMC/KYC onboarding process.
It is not an actual document but a declaration or form.
8. TIN or Other Tax Identification Number
Tax Identification Number is issued by the country where an investor is tax resident.
Depending on the country, the actual name can be different for tax identification numbers.
This is part of FATCA/CRS reporting to identify the investor for tax purposes.
9. Special Restrictions for NRIs from US and Canada
This is not a specific document. Instead, this is a specific pointer that NRI investor should know beforehand.
There are additional restrictions for NRIs living in US or Canada.
Some AMCs do not allow investments from NRI investors living in US/Canada.
However, this is only an AMC specific restriction and can easily be solved by choosing another AMC that allows it. Some AMCs might require you to provide some additional documentation.
Apart from the documents, this is one more pre requisite for any NRI investor. Check which AMC you are eligible for.
10. TDS on Mutual Fund Investments
Similar to the previous pointer, TDS is also not a document, but it is an important part of investing as an NRI.
Whenever an NRI redeems his mutual fund investments, with taxable income, the applicable tax may be withheld at source by AMC at the time of redemption.
If you are eligible to claim benefits under Double taxation avoidance agreement (DTAA), those provisions may become relevant as well.
Therefore, it becomes crucial to understand this beforehand so as not to get surprised at the time of redemption.
